The case of Tomasz Komenda, one of the most prominent cases in Polish history, started with the murder committed on New Year’s Eve 1997. Malgorzata K., 15, who had been having fun with friends at a nightclub in the southwestern town of Miloszyce between 1996 and 1997, went out of the club for a short time. The next day, it was understood that the unfortunate girl whose body was found in the empty area opposite the club was raped and frozen to death. Police detained Tomasz Komenda as the perpetrator. Komenda, who was arrested by the court where she was taken, stated that she had never seen the young girl and did not accept the accusations during the trial.
SUICIDE ATTRACTED MANY TIMES IN PRISON
Sentenced to 25 years in prison in 2000, Komenda sobbed in the courtroom when she heard the verdict. The unfortunate young man attempted suicide many times in the prison where he was put. While Komenda has been serving a prison sentence for 18 years, the family of the deceased Malgorzata K. applied to the Minister of Justice Zbigniew Ziobro to reopen the investigation in 2018 and the file was reopened.
REVEALED WITH THE REAL DNA TEST
As a result of the research and investigations made by the Wroclaw Prosecutor’s Office and police officials, it was revealed that the DNA test of the perpetrator and Komenda’s DNA did not match. When it was determined that the detected DNA belonged to Ireneusz M., who was recorded in the police, the person was arrested and sent to prison. As a result of the prosecutor’s application to the Supreme Court for his release on the grounds that he was not guilty, Komenda was released from prison in March 2018, where he spent 18 years innocent.
1 MILLION ZLOTI PER YEAR
Coming out of prison at the age of 42 due to a crime he did not commit, Komenda filed a lawsuit against the state for a total of 18 million zlotys, with 1 million zloty per year for the years he was stolen from prison. In the last hearing today, the court ruled that the state pay Komenda 12 million 811 thousand zloty (approximately 3 million euros) in compensation.

Komenda’s lawyer, Zbigniew Cwiakalski, said in a statement that they can appeal the decision, which is the largest compensation case in Polish history, for a higher amount, but they should first see the reasoned decision.
